Terms & Conditions of Use

These Terms & Conditions of Use ("Terms") govern your access to and use of the Pepps website, mobile applications, member portal, and any related products or services (together, the "Services"). Please read them carefully — by using the Services you agree to be bound by these Terms.

1. The agreement

These Terms form a legal agreement between you ("you" or "Member") and Pepps, Inc. ("Pepps," "we," "us," or "our"). By creating an account, placing an order, or otherwise using the Services, you acknowledge that you have read, understood, and agreed to these Terms, our Privacy Policy, and any supplemental terms that apply to specific Services. If you do not agree, do not use the Services.

Your use of the Services may also be subject to additional policies posted within the Services (including medical-intake forms, informed-consent documents, and pharmacy- partner terms), which are incorporated into these Terms by reference.

2. Eligibility

You must be at least 18 years old and a legal resident of the United States in a state where Pepps currently operates to create an account or purchase any Service. By using the Services, you represent and warrant that you meet these requirements and that all information you provide is accurate, current, and complete.

Some Services — including any physician consultation, prescription, compounded formulation, or injectable product — are available only to individuals who pass our medical-intake screening and are approved by a licensed Pepps physician. Pepps reserves the right to decline, suspend, or discontinue Services to any person at any time in its sole discretion or in the professional judgment of our physicians.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify Pepps immediately of any unauthorized use of your account. Pepps is not liable for any loss or damage resulting from your failure to safeguard your credentials.

You may not create an account on behalf of another person, share your account, or transfer your account to another person without our written permission. Each member must have a unique, individually-licensed physician relationship.

4. Pepps services

Pepps offers a membership platform that connects individuals with licensed telehealth physicians who may, in their independent clinical judgment, prescribe wellness protocols — including compounded medications and peptides produced by FDA-regulated compounding pharmacies. The specific Services available to you depend on your state of residence, medical intake, biomarker results, physician approval, and chosen plan.

Pepps is a technology and wellness platform. Pepps does not itself practice medicine. All clinical services are provided by independent, state-licensed physicians operating through professional corporations or practice groups that are affiliated with but not owned or controlled by Pepps, except where applicable law permits common ownership.

5. Medical relationship & informed consent

When you elect to pursue clinical Services, you enter into a separate patient-physician relationship with the Pepps-affiliated physician who reviews your intake. That physician — not Pepps — is responsible for clinical decisions, including whether to prescribe a protocol, what cycle to follow, and how to monitor your results.

Before any prescription is issued, you will be asked to review and electronically sign an informed-consent document specific to the compound(s) being prescribed. You may withdraw consent at any time by messaging your physician through the Pepps portal or by contacting Member Support.

Pepps is not a substitute for emergency medical care. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department.

6. Subscription & billing

Pepps offers recurring monthly and annual subscription plans. By purchasing a plan, you authorize Pepps (and its payment processor) to charge your payment method the applicable fee at the start of each billing cycle until you cancel. All prices are in U.S. dollars and exclude applicable taxes.

Price changes. We may change the price of a subscription plan with at least 30 days' notice before the change takes effect on your account. If you do not agree to a price change, you may cancel before the change takes effect.

Promotional pricing. Promotional or introductory prices apply only for the promotional period. After the promotional period ends, your plan will renew at the then-current standard price unless you cancel.

Failed payments. If a scheduled payment fails, we may suspend your Service and pause shipment of any compounded product until the balance is resolved.

7. Shipping & delivery

Compounded prescription products ship cold-chain directly from our FDA-regulated pharmacy partners to the shipping address you provide. Shipping is included in the price of most subscription plans within the continental United States. It is your responsibility to provide an accurate, monitored shipping address and to be available to receive temperature-sensitive shipments.

Pepps is not liable for shipping delays caused by carriers, weather, or circumstances beyond our reasonable control. If a shipment is damaged, compromised, or does not arrive, contact Member Support within 7 days and we will coordinate replacement per our pharmacy-partner policies.

8. Returns & refunds

Because compounded prescription products are prepared specifically for you and require cold-chain handling, all prescription sales are final and cannot be returned or resold once shipped. This is a regulatory requirement, not a Pepps policy choice.

If you have not yet received your first shipment and your physician has not yet issued a prescription, you may request a full refund within 14 days of purchase. If a product arrives damaged or incorrectly fulfilled, Pepps will work with the dispensing pharmacy to arrange a replacement at no cost to you.

9. Cancellation

You may cancel your subscription at any time through your account settings or by contacting support@pepps.com. Cancellation stops future renewals and future shipments. It does not refund payments already processed or shipments already dispatched.

You remain responsible for any outstanding balances on your account. Your member portal access and biomarker data remain available to you — you can export your data or request deletion at any time.

10. Acceptable use

You agree not to:

  • Provide false, misleading, or incomplete information during medical intake;
  • Resell, transfer, share, or divert prescribed compounds to any other person;
  • Use the Services for any unlawful purpose or in violation of any applicable law;
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Services;
  • Scrape, harvest, or otherwise extract data from the Services without permission;
  • Upload viruses, malicious code, or content that violates the rights of others.

Violation of this section may result in immediate suspension or termination of your account and may expose you to civil or criminal liability.

11. Intellectual property

The Services and all content, software, trademarks, logos, and proprietary materials (including the Pepps wordmark, the "p" logomark, the tagline Simple steps. Real results., and the names of our proprietary systems such as RECOVER, RENEW, OPTIMIZE, RESTORE, SHIELD, and FOCUS) are owned by or licensed to Pepps and are protected by U.S. and international intellectual-property laws.

Pepps grants you a limited, revocable, non-exclusive, non-transferable license to use the Services for your personal, non-commercial use. All rights not expressly granted are reserved.

12. User content

You retain ownership of any content you submit to the Services (such as messages to your physician, testimonials, or support inquiries). By submitting content, you grant Pepps a worldwide, royalty-free license to use that content solely for the purpose of operating, improving, and promoting the Services — subject to our Privacy Policy.

Your Protected Health Information (PHI) is treated separately and in accordance with HIPAA and our Privacy Policy. We do not use PHI for marketing without your explicit written authorization.

13. Third-party services

The Services may integrate with third-party providers — including pharmacy partners, laboratory partners, payment processors, shipping carriers, and analytics providers. Your use of a third-party service is governed by that provider's terms and privacy policy, and Pepps is not responsible for the acts or omissions of third parties.

14. Disclaimers

The Services are provided "as is" and "as available" without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Pepps does not warrant that the Services will be uninterrupted, error-free, or that defects will be corrected.

Statements on this site have not been evaluated by the U.S. Food and Drug Administration. Products and protocols are not intended to diagnose, treat, cure, or prevent any disease. Always consult a qualified healthcare professional. Individual results vary and are not guaranteed.

15. Limitation of liability

To the maximum extent permitted by law, Pepps and its officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. In no event will Pepps's total liability exceed the greater of (a) amounts paid by you to Pepps in the 12 months preceding the event giving rise to the claim, or (b) one hundred dollars (USD $100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages, so some of the above limitations may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Pepps and its affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your breach of these Terms; (c) your violation of any law or third-party right; or (d) any content you submit to the Services.

17. Disputes & binding arbitration

Please read this section carefully — it affects your legal rights. You and Pepps agree that any dispute, claim, or controversy arising out of or related to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that you may assert claims in small-claims court if they qualify.

The arbitration will take place in the county of your residence or at another mutually agreed location. The arbitrator's decision will be final and enforceable in any court of competent jurisdiction. Pepps will pay arbitration fees for claims under $10,000 unless the arbitrator finds the claim frivolous.

Opt-out. You may opt out of this arbitration provision by sending written notice to legal@pepps.com within 30 days of first accepting these Terms.

18. Class-action waiver

You and Pepps agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

19. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. For any matter not subject to arbitration, the parties agree to the exclusive jurisdiction of the state and federal courts located in Delaware.

20. Changes to these terms

Pepps may modify these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, give you reasonable advance notice (by email or in-app notice). Your continued use of the Services after the effective date constitutes acceptance of the modified Terms.

21. Termination

Pepps may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or if continuing to provide Services to you presents a clinical or operational risk. You may terminate your account at any time by cancelling your subscription and requesting account closure.

Sections that by their nature should survive termination will survive — including intellectual-property, disclaimer, limitation-of-liability, indemnification, dispute, and governing-law sections.
